I was sent an email from my condo board president detailing a list of violations that have brought against me. 4 of the violations are concerning noise. I have gone through our rules and regs and our bylaws and the wording in them concerning noise is limited and extremely vague. "It basically states "no offensive activity shall be carried on which may be an annoyance to the owners or occupants which in the judgment of the board causes unreasonable noise or disturbances to others"
They are setting a hearing date and plan on fining me about $300. How do I approach this hearing? 3 of the 4 board members are the complaintants. I have been in my condo for over 7 years and now that the owner under me and the owner across from me had children within the last year they feel that the noise level from my unit is unacceptable. How do I ensure that I get a fair and impartial hearing? How do you defend against or prove unreasonable noise?
My greatest fear is the board using fines to control how I live. What's to stop them from issuing a fine every time they feel my door closed to loud, people are walking to loud, or the TV is on too loud?
Everything I have been reading says I have a right to live in my unit and make a reasonable amount of noise but it is impossible to defend.
